As a result of joint actions, the Institute of the Ombudsman and the Ministry of Foreign Affairs of Kyrgyzstan refused to extradite a citizen of the Kyrgyz Republic from Russia to Tajikistan. This is reported by the press service of the chief Human rights defender.
As specified, a citizen of the Kyrgyz Republic I. A. was detained by employees of the border service of the FSB of the Russian Federation while crossing the border of Russia. The detainee was transferred to the Rubtsovskaya Transport Prosecutor's Office of the Altai Territory.
According to official data of Russian law enforcement agencies, the Kyrgyz citizen was detained after being put on the international wanted list by Tajik law enforcement officers.
After the arrest, the citizen of the Kyrgyz Republic was detained in a pre-trial detention center of the Altai Territory for 40 days by the decision of the Rubtsovsky District Court.
Kyrgyz Ombudsman Jamila Jamanbayeva was approached by representatives of the ethnic Kyrgyz community with a request to protect the rights of I. A. She took the case under special control, the report says.
The Ombudsman appealed to the relevant state bodies of Kyrgyzstan, calling on them to ensure the observance of the rights of a citizen of the Kyrgyz Republic - to assist in preventing the extradition of a compatriot to Tajikistan.
According to official data of the Kyrgyz state bodies, I. A. is an ethnic Kyrgyz, born in the village of Murghab in the Gorno-Badakhshan Autonomous Okrug of Tajikistan. In 2013, he was forced to move from Tajikistan to Kyrgyzstan. Then he received citizenship of the Kyrgyz Republic, as he is an ethnic Kyrgyz. Since then, he has lived in Kyrgyzstan and only this year left the country to work. However, he was detained while crossing the border with Russia.
According to the case file, in 2013 a criminal case was opened against I. A. in Tajikistan under the article "Unauthorized abandonment of a unit and place of service". I. A. worked under contract in a military unit of the Armed Forces of the neighboring republic from 2010 to 2013.
It is reported that as a result of joint actions of the Ombudsman Institute and the Ministry of Foreign Affairs of the Kyrgyz Republic, as well as with the active participation of the Consulate General of the Kyrgyz Republic in Novosibirsk, it was possible to protect the rights of a Kyrgyz citizen.
The relevant state bodies of Russia were presented with all the arguments for refusing extradition to Tajikistan and releasing the citizen of the Kyrgyz Republic.
The Rubtsovskaya Transport Prosecutor's Office accepted the arguments in defense of I. A. and ruled that the statute of limitations for bringing I. A. to criminal responsibility expired on August 6, 2019. The Federal Penitentiary Service of the Russian Federation decided to release him.
