Scandal at Akfa University: former rector asked the president for help

Возник конфликт между руководством университета кау (ранее Akfa) и родителями студентов, обучающихся в этом учреждении по программе неполного рабочего дня. Нынешняя администрация обвиняет в этом бывшего ректора. Бекзод Джалилов, возглавлявший университет Акфа в 2018-2022 годах, сообщил, что за этими делами стоял Абдужаббар Абдувахидов, бывший советник президента, брат бывшего хокима города Ташкента жахангира Артикходжаева.
Заключенный договор предусматривает, что учащиеся, обучающиеся в выпускном классе школы, должны одновременно закончить 1-й курс университета Akfa в рамках программы неполного рабочего дня и быть принятыми на 2-й курс университета, как только они закончат школу. Однако было сказано, что студенты, обучающиеся по данной программе в 2022-2023 учебном году, не будут зачислены на 2-й курс университета в новом учебном году и должны будут переучиваться на 1-й курс. После этого возник конфликт между администрацией и родителями учеников.

Студенты, которые должны были закончить неполный рабочий день и начать обучение на 2-м курсе в этом году, не были допущены к занятиям. Они заплатили за один учебный год по контракту 40 млн сумов. 

Новое руководство университета объяснило такое положение дел тем, что предыдущий ректор допустил нарушения, и студенты, зачисленные на 2 курс, не могут продолжить обучение, так как это не предусмотрено законом. По словам студентов, они были отключены от системы распознавания лиц у входа, а их студенческие удостоверения были изъяты.

Высшего учебного заведения Kun.uz информация, которую он предоставил ' GA, указывает на то, что предыдущее руководство университета было виновно в возникшей ситуации.

Для справки, банковский счет ООО Central Asian University открыт в Яшнабадском филиале АО “Узмиллий банк”. Банковский счет ООО Study for the success открыт в управлении практики Капиталбанка города Ташкента.

Также денежные средства, поступающие на счет ООО Б.Поглощено ООО, которое принадлежит супруге Джалилова.

Кроме того, Центральноазиатский университет сообщил, что департамент IJQK при Генеральной прокуратуре возбудил уголовное дело в отношении бывших должностных лиц au Financial Investment Team LLC и должностных лиц Cyber Genesis Systems LLC.После этого заявления Central Asian University бывший ректор учреждения Бехзод Джалилов выразил свое отношение к произошедшим событиям. 

В 2018 году мне предложили возглавить проект по созданию университета Akfa, а после открытия университета в 2019 году я был назначен ректором этого университета.

22 сентября этого года я решил написать это обращение в связи с предъявленными мне и нескольким другим бывшим сотрудникам руководством университета Akfa (ныне Central Asian University) обвинениями в необоснованном, то есть незаконном присвоении средств университета.

Нынешнее руководство университета обвиняет меня в том, что я использовал компанию Study for the success, которую я основал в 2015 году, для заключения взаимовыгодной сделки с университетом Akfa без предварительного согласия учредителей университета.

ООО Study for the success оказывает образовательные услуги (по лицензии) с 2015 года и занимается подготовкой студентов к поступлению в ведущие высшие учебные заведения города Ташкента.

С 2021 года ООО "Study for the success", как и многие другие образовательные центры республики, на основе меморандума и соглашения о сотрудничестве с университетом готовило потенциальных студентов к поступлению в университет, в том числе в рамках программы "неполный рабочий день", а также организовывало вступительные экзамены.

Согласно вышеупомянутым документам, университет AKFA гарантировал, что студенты, успешно завершившие программу International Foundation Diploma for higher education Studies (как мы ее называем неполный рабочий день), будут приняты на второй уровень без предварительного обучения. Причина в том, что этот подготовительный курс приравнен к foundation Year.

Учредители университета Акфа, в том числе и сам Джахангир обидович Артыкходжаев, знали о сотрудничестве образовательного учреждения с другими образовательными учреждениями. Кроме того, племянница Джахангира Обидовича Артыкходжаева К. также учился по этой программе и платил за обучение не за счет университета, а за счет Study for the success LLC. Учитывая вышесказанное, сказать, что основатели не знали об этом, неверно.

Я хотел бы отметить, что между Университетом AKFA и другими учебными центрами также были подписаны документы, аналогичные соглашению с компанией Study for the success. Однако установленный новым руководством запрет на прямое зачисление в фазу 2 никоим образом не распространялся на студентов, поступающих в университет по программе неполного рабочего дня из других учебных заведений.

Напомню, что я ушел с поста ректора университета Акфа из-за разногласий в политике управления университетом с Абдужаббаром абдувахидовым, который, хотя и имеет юридический статус и не оформлен с юридической точки зрения, представляет себя председателем наблюдательного совета. Кроме того, с момента моего увольнения в первой половине января 2023 года и до 22 сентября этого года новое руководство университета не возражало против сотрудничества с учебными центрами по программе неполного рабочего дня. Кроме того, в весеннем семестре 2023 года эти студенты обучались на территории университета без каких-либо препятствий и по окончании семестра, то есть в июне 2023 года, по приказу действующего ректора университета Камрона Гуломова были переведены на следующий этап или зачислены на 2-й этап. На основании настоящего приказа студенты Study for the success были уведомлены о зачислении во 2-й этап университета.

На встрече с родителями, состоявшейся 22 сентября, Камран Гуломов ранее отрицал наличие такого приказа. Когда ему показали приказ, он сказал, что понятия не имеет, что он подписал. Однако позже он сказал, что подпись под приказом была получена обманным путем. При этом следует отметить, что документы на подпись камрону гуломову вносит его человек после соответствующих проверок.

По сути, этот вопрос был поднят новым руководством только для того, чтобы подорвать мою репутацию, репутацию Study for the success LLC и репутацию нового проекта по созданию нового университета, над которым я сейчас активно работаю. Если их обвинения логичны и юридически обоснованы, то возникает логичный вопрос: почему новое руководство университета не подняло вопрос о закрытии программы неполного рабочего дня и прекращении сотрудничества с образовательными центрами с момента моего увольнения до 22 сентября 2023 года?

Кроме того, с ноября 2022 года, а также после моего увольнения представителями учредителя неоднократно проводился аудит деятельности университета с привлечением внешних экспертов, в том числе и финансовый. Эти проверки не выявили никаких нарушений.

С 2018 года по январь 2023 года, несмотря на трудности, обещанные учредителями средства не были выделены, я честно и добросовестно трудился над созданием и развитием этого университета. Первоначально основатели обещали выделить 100 миллионов долларов на реализацию этого проекта. Однако в итоге в проект не была вложена даже ⅓ часть этих средств. В связи с этим для своевременной реализации проекта Университет был вынужден взять кредит, а кредит и проценты выплачивались университетом самостоятельно в установленные сроки.

Представители группы компаний Akfa не оказали никакой финансовой помощи. Ситуация дошла до того, что мне пришлось направить 100 000 долларов в университет. На эти средства я купил мебель и оборудование для студенческого общежития, которое работает на территории университета с 2021 года по настоящее время.

In his statement, Jalilov notes that "the current leadership of the university accuses him of using the Study for Success company, established by him in 2015, in a mutually beneficial deal with Akfa University, without obtaining the prior consent of the founders of the university." 

"The founders of Akfa University, including Jahangir Artikhodjaev himself, knew about the existence of a third-party company that provided such services to the university free of charge. Moreover, the niece of Jahangir Artikhodzhayev himself also studied under this program and paid for her studies not at the expense of the university, but at the expense of Study for Success. Given the above, it is groundless to claim that the founders did not know about it," he said.

According to Jalilov, "he was forced to resign his position as rector at the beginning of this year on his own accord due to disagreements with Abdujabbor Abduvakhidov in the management policy of the university, who considers himself the chairman of the supervisory board of the university, although to date this status has not been legally assigned to him."

The statement of the former rector emphasizes that since November 2022, as well as after his dismissal, representatives of the founder, with the involvement of external experts, have repeatedly conducted inspections of the university's activities, including a financial audit. During these inspections, no violations on his part, as the rector of the university, were revealed.

Jalilov also added that the founders of the university did not allocate the entire amount of promised funds for its development.

"Initially, the founders promised to allocate $ 100 million for the implementation of this project. However, in the end, ⅓ of this amount was not invested in the project. In this connection, a loan was issued in the name of the university for the timely implementation of the project, which was repaid by the university independently within the time limits set in the loan agreement. Representatives of the Akfa group of companies did not provide any financial support, and, in fact, I had to use my own funds in the amount of $ 100,000 to purchase furniture and equipment for the student dormitory, which has been operating on the university's territory since 2021 to the present day," he said.

- I, Dzhalilov Behzod Sherzodovich, have been working in the field of education since 2012. I worked as a head of studies at the Academic Lyceum at the International Westminster University in Tashkent, also held the position of head of the academic department at the university itself, and also from 2016 to 2018 worked at Inha University in Tashkent as head of the department of admission of applicants. In 2018, I was invited to lead the project to create the Akfa University, and in 2019, after the opening of the university, I was appointed rector of this university.

In connection with the spread on September 22, 2023, by the leadership of Akfa University (the current name is "Central Asian University", hereinafter referred to as the "University") of unfounded accusations against me and several other, already former, University employees, namely, misappropriation of university funds, I decided to write this appeal.

The current management of the University accuses me of using the company "Study for Success", established by me in 2015, in a mutually beneficial transaction with Akfa University, without obtaining the prior consent of the founders of the University.

Firstly, OOO "Study for Success" has been providing educational services since 2015 (according to the license) and preparing students for admission to advanced universities in Tashkent.

Since 2021, Study for Success LLC, like many other educational centers of the republic, has interacted with the University on the basis of a memorandum and a cooperation agreement by preparing potential students for admission to the University, including under the Part-Time program, and organizing entrance exams.

According to the above-mentioned documents, Akfa University guaranteed students who successfully completed the International Foundation Diploma for Higher Education Studies program (Part-Time program, as we called it), enrollment in the second year, skipping the first year of the University, which is equivalent to a preparatory course (foundation year).

The founders of Akfa University, including Jahangir Abidovich Artikhodjaev himself, knew about the existence of a third-party company that provided such services to the University free of charge. Moreover, the niece of Jahangir Abidovich himself, K. Artikhodzhayeva, also studied under this program and paid tuition not at the expense of the University, but at the expense of OOO "Study for Success". Given the above, it is groundless to claim that the founders did not know about it.

I would like to note that there are identical agreements between the University and other training centers as with the company "Study for Success", on the basis of which students who successfully completed preparatory courses in these training centers were accepted to the 2nd year of the Akfa University. However, the ban imposed by the new leadership on enrolling immediately in the 2nd year did not apply in any way to students who entered the University through the Part time program from other educational centers.

I would like to remind you that I was forced to resign my position as rector of Akfa University at the beginning of this year on my own, due to disagreements with Abdujabbor Abduvakhidov in the management policy of the university, who considers himself the chairman of the Supervisory Board of Akfa University, although to date this status has not been legally assigned to him. Moreover, for all this time, since my dismissal in the first half of January 2023 to September 22, 2023, the new leadership of the university has not made any claims about cooperation with educational centers under the Part time program.

Moreover, these students studied without any obstacles during the spring semester of 2023 at the University and at the end of the semester, namely in June 2023, Kamran Gulamov, the current rector of the university, issued an order to enroll “part-time” students in the 2nd year of the university, on the basis of which students Study for Success, a notification was sent about enrollment in the 2nd year of the University.

At a meeting with parents held on September 21, Kamron Gulomov denied the existence of such an order. When they showed him the order, he said he didn't know what he was signing. He later stated that the signature under the order was obtained fraudulently. It should be noted that his person, after appropriate checks, provides documents to Kamron Gulomov for signature.

In fact, this issue was raised by the new management only to damage my reputation, the reputation of OOO "Study for Success", and the university, whose project I am currently actively working on. If their accusations were rational and legally justified, then a logical question arises: why did the new leadership of the University not raise this issue about the closure of the "Part time" program and the termination of cooperation with educational centers from the moment of my dismissal until September 22, 2023?

In addition, I would like to inform you that since November 2022, as well as after my dismissal, representatives of the founder, with the involvement of external experts, have repeatedly conducted inspections of the University's activities, including a financial audit. During these inspections, no violations on my part, as the rector of the University, were revealed.

From 2018 to January 2023, I worked conscientiously and honestly on the creation and development of this university, despite the difficulties and the failed allocation of promised funds from the founders. Initially, the founders promised to allocate $ 100 million for the implementation of this project.  However, in the end, ⅓ of this amount was not invested in the project. In this connection, a loan was issued in the name of the university for the timely implementation of the project, which was repaid by the university independently within the time limits set in the loan agreement.

Representatives of the Akfa group of companies did not provide any financial support, and, in fact, I had to use my own funds in the amount of $ 100,000, including furniture and equipment for the student dormitory, which has been operating on the University's territory since 2021 to the present day.

After my resignation from the post of rector and the active involvement of Abdujabar Abduvakhitov (Jahangir Abidovich's matchmaker) in the life of the university, there have been changes in the approach to financing the University as a whole. The companies of Jahangir Abidovich Artikhodzhayev, actively began to allocate funds for the purchase of equipment, books and educational materials necessary for the educational process at the university.
