The Ministry of Internal Affairs has discussed the draft law "On amendments and additions to the Code of Administrative Responsibility of the Republic of Uzbekistan in connection with the improvement of liability for offenses against property."
By amending Article 61 of the Code of Administrative Responsibility by stealing, misappropriating, misappropriating other people's property, abusing official position or fraud it is proposed to consider the administrative penalty of three to ten times the amount of the basic calculation or administrative detention for a period of up to ten days for a small amount of robbery.
Also, in the second part of the article, if the same offense committed in enterprises, institutions, organizations, regardless of the form of ownership, is repeated within one year after the application of the administrative penalty, ten times the amount of the base calculation a fine of up to five times or administrative detention for a period of up to fifteen days is envisaged.
By supplementing this article with the fourth part, it is proposed that a person who has committed an offense for the first time, voluntarily compensates for the damage, will not be subject to the type of punishment associated with administrative imprisonment.
With the amendment of the fifth part of the article, it states that if the value of the looted property of citizens does not exceed three times the amount of the base calculation, as well as the value of the looted property of enterprises, institutions, organizations does not exceed 30 times the amount of the base calculation, such looting is a small amount of loot - it is intended to indicate that it is considered extortion.
In the sixth part of the article, offenses related to small amount of looting of the property of individuals are not qualified by this article in case of committing the symptoms of the corresponding part clauses given as an aggravating circumstance in the corresponding articles of the chapter on looting of other people's property of the Criminal Code. and is proposed to be the basis for criminal prosecution.
